TERMS & CONDITIONS

1. Introduction 

  • 1.1. These Terms & Conditions (“T&Cs”) govern the relationship between you (the “Client”) and THOMAS ASHLEY (“we”, “us”, “our”), a sole trader acting as a travel booking facilitator. 
  • 1.2. We act solely as an agent in arranging and facilitating bookings for travel services, including but not limited to hotels, flights, rental cars, and experiences (collectively, the “Services”). 
  • 1.3. By using our Services, you agree to these T&Cs.


2. Our Role as an Agent
 

  • 2.1. We do not provide or operate any travel services ourselves but facilitate bookings on behalf of third-party suppliers (“Suppliers”). 
  • 2.2. Your contract for the Services is directly with the Suppliers, and their terms & conditions apply. 
  • 2.3. We accept no liability for the provision of the Services, including but not limited to issues relating to cancellations, delays, or changes made by the Suppliers.


3. Booking Process
 

  • 3.1. When you request a booking, we will facilitate the reservation with the relevant Supplier(s) on your behalf. 
  • 3.2. Payment terms, cancellation policies, and any amendments to bookings are subject to the terms of the Supplier(s). 
  • 3.3. We are not responsible for any changes made by the Supplier(s) and will assist you in liaising with them where necessary.


4. Liability Disclaimer
 

  • 4.1. As we act solely as an agent, we are not responsible for the performance, quality, or safety of any travel services provided by Suppliers. 
  • 4.2. We shall not be liable for any losses, damages, or claims arising from issues related to the Services, including but not limited to cancellations, delays, injuries, or force majeure events. 
  • 4.3. Any complaints or disputes regarding the Services must be directed to the relevant Supplier.
  • 4.4. As we act solely as an agent, we are not liable for any outstanding payments, balances, disputes, or financial obligations owed to or by any Supplier. All such obligations remain solely between the Client and the relevant Supplier. Under no circumstances shall we be responsible for settling, covering, advancing, or guaranteeing any payments relating to the Services, including in the event of dispute, service failure, or dissatisfaction.

5. Financial Protection

  • 5.1. As we do not provide package holidays, we are not subject to the Package Travel and Linked Travel Arrangements Regulations 2018. 
  • 5.2. Payments made for bookings are processed directly with the Supplier(s) unless otherwise stated. 
  • 5.3. We strongly advise Clients to obtain comprehensive travel insurance covering cancellations, medical expenses, and unforeseen disruptions.

6. Fees and Payment 

  • 6.1. We may charge a service fee for facilitating bookings, which will be communicated before confirming your reservation. 
  • 6.2. All payments are subject to the Supplier’s terms, and we are not responsible for their refund policies.
  • 6.3. All payments relating to the Services are made directly to the relevant Supplier(s) unless otherwise agreed. We do not hold client funds as principal and are not responsible for any non-payment, shortfall, or dispute between the Client and the Supplier.

7. Cancellations & Amendments 

  • 7.1. Upon request, we will act on your behalf to facilitate cancellations or amendments with the Supplier(s); however, all changes remain subject to the Supplier(s)’ policies, and we cannot guarantee any refunds, credits, or modifications.
  • 7.2. While we will assist in communicating with the Supplier(s), we have no authority to override their policies and accept no liability for any fees, charges, or losses incurred as a result of cancellations or amendments.


8. Governing Law
 

  • 8.1. These T&Cs are governed by and construed in accordance with the laws of England and Wales. 
  • 8.2. Any disputes arising from these T&Cs shall be subject to the exclusive jurisdiction of the courts of England and Wales.


9. Passports, Visas & Entry Requirements

  • 9.1. It is the sole responsibility of the Client to ensure that they hold valid passports, visas, ESTA/ETA approvals, health certificates, vaccination documentation, and any other documentation required for entry, transit, or travel to any country included within their itinerary.
  • 9.2. We do not provide visa advice, immigration guidance, or consular services. We are not responsible for advising on visa or entry requirements, monitoring changes to immigration regulations, or reminding Clients to obtain the necessary travel documentation.
  • 9.3. We strictly do not apply for visas or entry clearances on behalf of Clients under any circumstances.
  • 9.4. Visa and entry requirements may change at short notice. Clients must check requirements directly with the relevant embassy, consulate, or official government authority for each destination and any transit country prior to travel.
  • 9.5. We shall not be liable for any costs, losses, denied boarding, refused entry, delays, cancellations, or additional expenses arising from incomplete, incorrect, or missing travel documentation.
  • 9.6. Failure to obtain appropriate travel documentation shall not constitute grounds for cancellation or refund of any confirmed travel arrangements.
